Events and other items purchased on this system are supplied by ARTS MARGARET RIVER INCORPORATED (ABN 61 874 730 774) Nala Bardip Mia – Margaret River HEART, 47 Wallcliffe Rd, Margaret River, Western Australia, 6285. Purchase of tickets to events or other items supplied by us constitutes an agreement to the following Terms and Conditions.
Advertised Ticket Prices
Ticket prices include GST where applicable but are exclusive of ticketing fees and credit card surcharges which may be added at the checkout.
Customers bearing tickets purchased online at a discount price (such as student, pensioner, concession) will only be admitted upon production to Box Office staff of relevant ID prior to the event. Failure to produce appropriate ID may result in the patron being charged full price for their ticket.
Prices are in the currency shown on the checkout page and tickets will only be issued upon full payment.
Subject to availability, tickets may be available for purchase at the Box Office up to 30 minutes prior to each event.
Every patron must have a valid ticket.
Your Rights and Obligations
You agree to provide us with, at minimum, your first and last name, email contact address and mobile number or as required on the checkout page for the purpose of facilitating delivery of tickets and your access to the event.
You agree to receive such communications from us that facilitate your access to the event or items you have purchased, whether by email, SMS or other means.
You also agree to receive information about updates or changes in status to the events or items you have purchased.
You acknowledge that we will reasonably inform you of changes to the event, but that we bear no responsibility in the event that you are unable to receive our communications for whatever reason.
If you elect to join our mailing list either during the checkout process or at another point on our website, you agree to receive marketing communications from us. You may revoke permission to receive these marketing messages by unsubscribing at the website listed in our marketing communications.
If you elect to share information about the purchase of an event or item by you, you grant us permission to share this information to the social media channels you have elected to share on.
You agree to comply with the reasonable instructions given by our event staff.
You agree not to resell your ticket in any circumstances.
If you are accompanied by minors, you agree to be responsible for their care and actions, at all times.
We reserve the right to refuse admission to you, or remove you from the event, without any liability, if we deem this is necessary due to you presenting a security risk, nuisance or annoyance to other patrons of the event. The right of admission is reserved by the Box Office staff at any venues associated with Arts Margaret River events. Latecomers will not be admitted until there is a convenient break in the program, if at all, and admission is at the discretion of the Box Office personnel.
Unaccompanied Minors
Children under 8 years old cannot attend a screening unaccompanied (regardless of certification). They should be accompanied by an adult aged 18 years or older.
Children under 12 cannot attend a screening unaccompanied after 7pm (regardless of certification).
Children on Lap
Arts Margaret River policy is that any child that is two years of age or older requires a ticket. Children under two years of age enter free of charge, and therefore do not require a ticket. However, they will be expected to sit on an adult’s lap as they will not be issued with a seat. Children under 2 are free if held by an adult (lap child). If the child requires a separate seat, a Child ticket must be purchased.
Individual touring companies may have varying policies related to this, so you may find that different age stipulations apply. Please contact the venue prior to attending an event to check. If your child does not require a ticket, they will be expected to sit on an adult’s lap as they will not be issued with a seat.
Assistance Animals
For the comfort and safety of all patrons, only approved Assistance Animals are allowed access to the theatres. These are Qualified Guide Dogs, Guide Dogs in Training, Autism Assistance Dogs and Dog or puppy-in-training. For further information please refer to Guide Dogs WA website and/or relevant State and Commonwealth legislation.
Venue Attendance Requirements
To help ensure the safety and security of the venue, bags and personal belongings may be subject to visual inspection.
Umbrellas, prams, backpacks, larger bags and other items that may be hazardous or restrict the movement of visitors may not be permitted into the venue or may be required to be cloaked, depending on the nature of the event and relevant circumstances.
It is your responsibility to collect any cloaked items after the performance.
No glass containers are allowed into any theatre.
Other items that are prohibited inside the facility include but are not limited to: alcohol purchased from outside; glass bottles; offensive signs or clothing, laser pointers; and any other items that could present a safety hazard to others or interfere with the performance.
Commercial activity including promotions, marketing, photography and filming are not permitted unless expressly authorised by the venue.
You must switch your mobile phone to silent while in a theatre or auditorium or on a tour.
No smoking or vaping is permitted in the building or the surrounding precinct.
Refrain from running in aisles, hallways, staircases or foyer.
Refrain from bringing in outside food or beverages.
You will treat all staff and volunteers with respect.
No dancing in seats except where there are no patrons sitting behind them and/or where other patrons would not be disrupted by the dancing.
Parents/Adult Guardians will monitor children brought into the theatre to ensure their safety and that they are not disruptive to others.
You must dispose of chewing gum in proper waste receptacles.
You must refrain from recording via any means, including social media platforms, the presentation at the event, unless invited to do so by a presenter.
Safety is a priority, and you must not bring weapons into the facility.
You will not dress in an inappropriate manner, as determined by the sole and exclusive judgment of management.
You are asked to refrain from bringing in large purses, bags or backpacks into the facility.
If you do not adhere to these provisions you will be asked to leave the premises without refund.
Staff and volunteers have been trained to intervene where necessary to help ensure that the above expectations are met. You are encouraged to report any inappropriate behaviour to the nearest Team Member.
If any patron becomes disruptive and this impacts the enjoyment of other customers, they will be asked to leave the theatre. An unaccompanied child who is asked to leave the theatre must remain in the foyer until a parent or guardian collects them.
Passes
Currently relevant to Margaret River Readers and Writers Festival only.
Passes allow the pre-purchase of a set number of events that can be booked in the future. A pass does not guarantee entry to an event, the pass must be used to book tickets to the event to guarantee a ticket. Certain events may not be valid on a pass. Depending on the event, the prices to book the event on the pass may range from free to an additional price payable as advised. Depending on the type of pass, you may be able to book 1 or more tickets to the same event (refer to the pass description for more details).
Merchandise
Merchandise items sold and supplied by us can be collected at the event or as otherwise advised.
Membership
Membership typically applies to a single person, for a period of 12 months from 1 January to 31 December of a calendar year. Membership entitles you to a range of member benefits that are detailed on the Member page. You must renew the membership within 30 days past the date of expiry of the membership to maintain the membership. Failure to do so will require the purchase of a new membership.
Gift Vouchers
Gift vouchers may be purchased from Arts Margaret River and are valid until the date shown on the gift voucher. They are not refundable at any time and cannot be redeemed for a cash value. Vouchers which expire past the date printed on the voucher cannot be used. Arts Margaret River Gift Vouchers can be redeemed for tickets to participating events on sale through www.artsmargaretriver.com or from the Margaret River HEART (Nala Bardip Mia) Box Office.
Arts Margaret River Gift Vouchers cannot be redeemed for tickets to events where it is a condition that a specific credit or debit card is required to complete the transaction.
Fees may apply at the time an Arts Margaret River Gift Voucher is purchased. Standard GST, service/delivery and credit card fees will apply when an Arts Margaret River Gift Voucher is redeemed.
Arts Margaret River Gift Vouchers are valid for 3 years from the date of purchase and must be redeemed within that period.
Arts Margaret River will not refund Arts Margaret River Gift Vouchers unless required by law.
Arts Margaret River Gift Vouchers are partially redeemable. If the cost of the ticket purchase exceeds the redeemable value of an Arts Margaret River Gift Voucher, the voucher holder is required to pay the difference between the purchase price of the ticket and the value of the Arts Margaret River Gift voucher. The full value of any unused credit remaining on an Arts Margaret River Gift Voucher must be redeemed before alternative payment methods will be accepted in respect of the outstanding balance of the transaction.
Multiple Arts Margaret River Gift Vouchers may be used to redeem tickets in a single transaction. A limit of 2 Arts Margaret River Gift Vouchers can be redeemed per transaction.
If the purchase price of an event ticket is less than the value of an Arts Margaret River Gift Voucher used for redemption, the residual credit balance of the Arts Margaret River Gift Voucher will remain on the voucher and may be redeemed in the future in accordance with these Terms and Conditions.
Arts Margaret River Gift Vouchers cannot be resold or exchanged.
Arts Margaret River Gift Vouchers cannot be redeemed for further Arts Margaret River Gift Vouchers.
Arts Margaret River Gift Vouchers are not reloadable. When the value of an Arts Margaret River Gift Voucher is redeemed, the voucher cannot be reloaded.
Arts Margaret River may cancel an Arts Margaret River Gift Voucher, refuse redemption or cancel tickets redeemed using an Arts Margaret River Gift Voucher if it suspects that an Arts Margaret River Gift Voucher is being used fraudulently, in an unauthorised or illegal manner, or it has reason to believe that the voucher holder is in breach of these Terms and Conditions.
An Arts Margaret River Gift Voucher is non-refundable and non-returnable, except in accordance with your legal rights. You cannot cancel a Gift Voucher.
A Gift Voucher has no cash redemption value and cannot be exchanged for cash, nor can any cash advance be made on any portion of the value that was loaded onto the Gift Voucher at the time of purchase.
A Gift Voucher cannot be exchanged for a different denomination, nor can the unused value of two or more Gift Vouchers be consolidated onto a new Arts Margaret River Gift Voucher.
A Gift Voucher cannot be used after 3 years from date of purchase of the Gift Voucher, (even if all or part of the value loaded at the time of purchase remains on the card), and nor can a refund of any unused value remaining on the Gift Voucher be claimed.
Upon expiry of the Gift Voucher any unused value remaining on the Voucher is forfeited.

Please contact Arts Margaret River as each event may have a specific exchange policy.
Refunds
There are no refunds on any ticket except as required by Australian Consumer Law. Patrons should be aware that refunds are only given in accordance with the Live Performance Australia (LPA) Ticketing Code of Practice and that exchanges could incur a fee per ticket.
The Presenter of an event may add, withdraw or substitute artists (including the opening act/s) or vary advertised programs, performance times, venue, seating arrangements or audience capacity. Tickets will not be exchanged or refunded because of these changes, except as provided for in the LPA Code or as required by law (including the Australian Consumer Law).
If an event is cancelled, rescheduled or significantly relocated and provided Arts Margaret River receives authorisation from the Presenter, Arts Margaret River will attempt to notify ticket holders of the cancellation, rescheduling or relocation. However, Arts Margaret River does not guarantee that ticket holders will be informed of such cancellation, rescheduling or relocation prior to the event.
You may be entitled by Australian Consumer Law or under the LPA Code to a refund where an event is cancelled, rescheduled or significantly relocated. To the extent permitted by law (including the Australian Consumer Law), neither Arts Margaret River nor the venue will reimburse you for auxiliary expenses (such as the cost of travel, car-parking, child-care and accommodation) or other consequential loss suffered by you in connection with your attendance or non-attendance at an event. Arts Margaret River recommends that you obtain ticket and/or travel insurance for those expenses.
To the extent permitted by law (including the Australian Consumer Law), neither Arts Margaret River nor the venue are liable to refund to you any amount beyond the face value of the ticket.
If Arts Margaret River reasonably forms the view that a ticket has been:
- Purchased with a stolen credit card;
- Resold for a profit; or
- Has been otherwise purchased or acquired fraudulently,
Arts Margaret River may cancel the ticket.
Where Arts Margaret River reasonably forms the view that the ticket was purchased with a stolen credit card, Arts Margaret River will take reasonable steps to refund the ticket price to that credit card unless it is unable to do so (for example, where the credit card has been cancelled).
By clicking the “Checkout” button, you are agreeing to these Terms and Conditions of sale, including the Refund section. All orders are subject to credit card approval and billing address verification.
Arts Margaret River assumes no responsibility for any error, omission, interruption, deletion, defect, delay in transmission, or line failure and reserves the right to add, withdraw or substitute artists and to vary the program should the need arise.
If the event has had to be materially changed or postponed for circumstances beyond our control. In this case we may either offer refunds or substitute an equivalent event, or in certain other compassionate circumstances.
After the event has been held, you are not entitled to any refund on unused tickets or purchases made if you cannot prove that you contacted us in writing prior to the event.
Complimentary or free tickets are not valid for any refund or form of exchange.
You agree not to re-sell any tickets for profit and that Tickets must be purchased from an authorised ticket seller. Tickets purchased from Ticketmaster Resale, Viagogo, Ticketbis, eBay, Gumtree, Tickets Australia or any other unauthorised re-seller may be cancelled without notice and/or the holder may be refused admission to the Event.
Donations will not be refunded, even if they form part of an overall ticket price for a fundraising event.
We may offer refunds before the event if you are unable to attend e.g. due to Covid-19 infection.
Covid-19
Arts Margaret River will be following all government requirements and guidelines in our management of Covid-19. These requirements and guidelines are subject to change and in some cases, there will be very little notice. The safety of our audiences, performers, authors, presenters, artists, volunteers and staff is our highest priority and we ask that, if you have tested positive to Covid-19, you do not attend. A refund can only be issued to ticket holders who can prove their positive Covid-19 status at the time of the event.
Cancellations
If the event is cancelled you will receive a refund of the face value of the tickets.
Complimentary or free tickets to events that are cancelled are not valid for any refund or exchange to other events.
Outdoor Events
Where we supply events outdoors you acknowledge that these events are subject to adverse weather conditions, and that we have the right to run the event in conditions which you may consider unsatisfactory. We also have the right to cancel or postpone events in cases where we consider weather conditions are unsafe or dangerous for our staff or customers to attend.
We have the right to supply an equivalent event indoors if we so choose.
Your Property at Events
You acknowledge that you should be vigilant of your own property and ensure that any property you bring to an event does not impact the health and safety of our staff or other patrons.
We are not liable for any personal effects in the case of theft or damage, however caused.
Dangerous items such as flagpoles, flares, weapons, propellant fuels, fireworks or other items of a dangerous nature are not permitted at events at any time. Possessing these items onsite will result in police escorting you from the event, and possible legal charges.
Alcohol
Where the event has an alcohol licence you agree that you will comply with the terms of the licensee which includes consuming alcohol responsibly in designated areas by only people who are 18 years and older. You may not supply alcohol to persons under 18 years, nor bring alcohol to a licensed event premises. Penalties apply under WA state legislation for failure to comply with alcohol licence conditions.
Alcohol purchased from outside the venue is prohibited, except if you are permitted as an event organiser.
18 and Over Events
Where an event is designated as an 18 and over event, it is prohibited to purchase tickets for or supply tickets to persons aged under 18 years.
You, and ticket holders you purchase tickets for, must carry valid photo ID as proof of age, and present this to event staff when required.
Accessibility
You acknowledge that while we attempt to provide an accessible venue, in some cases it may not be possible to facilitate access for some people. If you have any accessibility concerns, please contact us prior to the purchase of your tickets.
Events which are accessible will be denoted as such. Any special requirements for accessibility will be considered if possible and they are made known to us.
Companion Card
Where required, a free companion card ticket may be supplied on presentation of a valid companion cardholder number. This person should always accompany the companion cardholder during the event.
Customer Feedback
Customer feedback is valued and welcomed.
If you experience a problem or issue with our venue or our services, please let our staff know promptly and we will make reasonable efforts to address the issue.

Limitation of Liability
You use the venue and the premises for the event at your own risk.
You indemnify us against:
(a) any accident, damage, personal injury, death, loss, illness or injury to you or a person under your care;
(b) any property damage, loss of or damage to your equipment, materials or other belongings brought to the venues, whether by fire, theft, accident, injury or otherwise; or
(c) any other loss, damage, cost or expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or indirect damage of any kind whether or not such loss or damage is foreseeable, foreseen or known and whether or not we have been advised that such damages may be incurred), unless solely caused by us, our staff or our representatives.
Changes to Terms and Conditions
We reserve the right to change these terms and conditions from time to time as required.
